PRIVACY AND PERSONAL DATA PROTECTION POLICY

This Privacy Policy (hereinafter referred to as the "Policy") sets forth the procedure for collecting, receiving, processing, storing, and protecting personal data of users of the website https://udaci-tech.com/ (hereinafter referred to as the "Website").

1. GENERAL PROVISIONS AND DATA CONTROLLER

1.2. By using the Website, registering an Account (whether as an Employer or a Specialist), or submitting their data, the User fully accepts the terms of this Policy.

1.3. If the User does not agree with the terms of this Policy, they must immediately cease using the Website.

2. CATEGORIES OF DATA PROCESSED

2.1. udaci-tech processes the following categories of data depending on the User's status:

2.1.1. Specialist (Candidate) Data: Full name; Contact details (email address, phone number, links to instant messengers); Resume/profile details: education, work experience, professional skills, language proficiency, desired rate, portfolio; History of job applications (responses) and reviews/ratings received from Employers.

2.1.2. Employer (Company) Data: Company name, registration details (EDRPOU code/Tax ID), registered address; Full name, position, phone number, and email address of the authorized representative of the Company; Payment and banking details (for performing settlements and paying the Commission).

2.3. Technical and Automated Data: IP addresses, cookies, device data, browser type, visit timestamps, and traffic sources.

3. PURPOSES OF PERSONAL DATA PROCESSING

3.1. Personal data is processed exclusively for the following purposes:

3.1.1. Ensuring the operation of the Website as a technological platform (marketplace) for independent search and interaction between Employers and Specialists.

3.1.2. Creating and administering User Accounts.

3.1.3. Providing the "Direct Connect" service and unlocking Specialists' contact details for Employers upon payment of the commission.

3.1.4. Executing B2B contracts under the "Outstaffing" model.

3.1.5. Processing settlements, administering payments, and issuing primary accounting documents.

3.1.6. Maintaining a system of ratings and reviews regarding the quality of cooperation.

3.1.7. Sending system notifications, support messages, and information materials (with the User's consent).

4. LEGAL BASIS FOR PROCESSING

4.1. udaci-tech processes personal data on the following legal grounds:

  • The User's consent to the processing of their personal data;

  • Performance of a contract (Website Terms of Use) to which the User is a party;

  • Compliance with legal obligations imposed on udaci-tech by applicable law;

  • Legitimate interests pursued by udaci-tech (prevention of fraud, ensuring Website security).

5. DATA TRANSFER TO THIRD PARTIES

5.1. Data transfer between Users: By applying for an Employer's job posting, the Specialist grants explicit consent to transfer their profile/resume data to such Employer. The Employer gains access to the Specialist's direct contact details upon fulfilling the conditions of the "Direct Connect" service.

5.2. Service Providers: udaci-tech reserves the right to transfer the minimum necessary data to payment systems (for payment processing/acquiring), hosting providers, and email service providers solely to ensure the technical performance of the Website.

5.3. udaci-tech does not sell or transfer personal data to third parties for marketing purposes.

5.4. Disclosure of data to public authorities is carried out strictly in cases directly provided by applicable law.

6. DATA RETENTION PERIOD

6.1. Personal data is retained for the entire duration of the User's active Account on the Website.

6.2. In the event of Account deletion by the User, their personal data shall be erased or anonymized, except for data required to be stored pursuant to statutory requirements.

7. USER RIGHTS

7.1. The User has the right to:

  • Access their personal data and information regarding the conditions of its processing;

  • Demand rectification of inaccurate or outdated data;

  • Demand erasure of their personal data ("right to be forgotten");

  • Withdraw consent to personal data processing (by submitting a corresponding request);

  • Restrict data processing or object to its processing;

  • Lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights or with a court.
